Terms of Service

These Terms of Service and Sale (“Terms”) govern your access to and use of BetHoop (“BetHoop”, “we”, “us”), an AI-powered NBA and WNBA analysis service operated from France. By creating an account, ticking the acceptance box at signup, or using the service, you accept these Terms in full. If you do not agree, do not use BetHoop.

1. Publisher identification (legal notices)

Pursuant to Article 6 III of the French Act n° 2004-575 of June 21, 2004 on confidence in the digital economy (LCEN):

  • Postal address: to be completed before public paid launch.
  • SIREN / RNE number: to be completed upon incorporation.
  • VAT (intra-EU): to be completed if applicable.

BetHoop does not hold an ANJ license (French national gambling regulator), as BetHoop does not organize any gambling activity and accepts no wagers. See Section 2.

2. Service description and nature

BetHoop provides predictive analyses of NBA and WNBA games: win probabilities, projected scores, suggested picks, advanced statistics and contextual factors, produced by a proprietary mathematical model assisted by artificial intelligence.

BetHoop is an informational decision-support tool. It does not replace your judgment, your strategy, or your decision-making. It is not:

  • A gambling operator within the meaning of Articles 14 et seq. of French Act n° 2010-476 of May 12, 2010. We do not accept wagers, do not facilitate any betting transaction, and hold no gambling license (ANJ or foreign equivalent).
  • An investment advisory service within the meaning of Articles L321-1 et seq. of the French Monetary and Financial Code, nor a regulated investment adviser in any other jurisdiction. No BetHoop output should be interpreted as financial, tax or investment advice.
  • A licensed sports tipster servicewithin the meaning of the French Sports Code. We are not regulated tipsters and our analyses do not replace a licensed professional's judgment.

No analysis tells you to place a bet, nor what amount to wager. The decision to gamble or not, and the amount, are exclusively yours and engage your sole responsibility. See also our Responsible Gambling page.

3. Eligibility & geographic availability

  • You must be at least 21 years old if you reside in the United States, at least 19 years old in most Canadian provinces, or otherwise of the legal gambling age in your jurisdiction.
  • You must not use BetHoop from a jurisdiction where the discussion, publication or promotion of sports betting picks is prohibited. You are solely responsible for verifying the legality of your access.
  • We may use IP-based geo-detection to restrict access from jurisdictions we consider incompatible with the service.
  • BetHoop is not directed at, nor intended for, persons under the legal gambling age. We will close any account upon credible report of underage use.

4. Account creation & acceptance

Authentication is handled by Clerk. To create an account you must (a) provide accurate information, (b) be of legal gambling age, and (c) explicitly accept these Terms and our Privacy Policy via the acceptance checkbox displayed at signup. We record the version of the Terms accepted, the date and time of acceptance, and your IP address as evidence.

5. Subscription, pricing, quotas & billing

5.1. Plans and quotas. Paid plans grant access to analyses within the following limits:

  • Starter: 10 analyses per rolling 30-day window, 3 suggested picks visible per analysis, full public results history.
  • Pro: 2 analyses per rolling 24-hour window, no carry-over between days, 6 suggested picks per analysis, access to bold picks.
  • Elite: unlimited analyses, up to 10 suggested picks per analysis, automatically tuned risk profile.

Re-visiting an analysis already unlocked within the current window does not consume a new quota slot. Above the quota, access to new analyses is suspended until the rolling reset. Unused quota does not give rise to any refund.

5.2. Pricing and currency.

  • Paid plans are billed in euros (€) for users in France and the eurozone, in US dollars ($) for other jurisdictions, determined by the service display language at the time of payment. Conversion is handled by Stripe Payments Europe Limited.
  • Current prices are displayed on the pricing page. Any price change will be notified by email and in-app at least 30 days before it takes effect, in accordance with Article L221-8 of the French Consumer Code. Existing subscribers keep their price until the next renewal following that notice.
  • Taxes and currency conversion fees applicable in your country are your responsibility.

5.3. Marketing performance indicators.Performance figures published on our site (notably win rate and average monthly gain) are computed on a reference sample of Pro users strictly following the “Safe” and “Likely” picks, over a reference monthly wagered volume ($5,000 or EUR equivalent). These figures are not a promise nor a guarantee of individual results. Your personal results may differ significantly based on your discipline, volume and strategy. 5.4. No free trial. The free preview (approx. 15% of an analysis) is the introductory tier and replaces any trial.

5.5. Renewal and cancellation.

  • Subscriptions renew automatically at the end of each billing period until cancelled.
  • You may cancel at any time through the Stripe Customer Portal accessible from your account menu, without contacting us, in accordance with Articles L215-1 and L215-1-1 of the French Consumer Code (three-click cancellation). Cancellation takes effect at the end of the current billing period; you keep access until that date.
  • For subscribers residing in France, tacit renewal of any one-year fixed-term contract triggers an email notification between three and one month before the term (Article L215-1 of the French Consumer Code), allowing you to opt out of renewal.

5.6. Right of withdrawal (Article L221-18 of the French Consumer Code).A 14-day withdrawal period normally applies to distance contracts. However, by checking the acceptance box at signup and then requesting immediate execution of the service before the end of that period (unlocking a full analysis), you expressly waive your right of withdrawal on the digital content already delivered (Article L221-28, 13° of the French Consumer Code). The unused portion of a paid period is not refunded.

5.7. Discretionary refunds. Outside of the above, all sales are final. Refunds may be granted at our sole discretion in cases of duplicate charges, service unavailability we are responsible for, or documented technical failure preventing use.

5.8. Promotional codes. Promotional codes (including those from affiliate partnerships) apply only to the first billing period, cannot be combined, are non-refundable and expire on the indicated date. No code may be applied retroactively to an existing subscription.

6. Acceptable use

You agree not to:

  • Scrape, copy, mirror or redistribute BetHoop content in bulk or to train any model.
  • Use the service to facilitate illegal gambling, money laundering, or any unlawful activity.
  • Attempt to circumvent paywalls, authentication, rate limits or security controls.
  • Reverse-engineer the prediction engine or any related model.
  • Share, lease or resell access to your account.
  • Use automated agents, bots or scripts against the service.

Breach of this section may lead to immediate suspension or termination, without refund of any paid period.

7. Decision-support tool, not advice; no guaranteed outcome

BetHoop's outputs are statistical estimates produced by a mathematical model. They do not constitute investment advice, financial advice, betting advice, or regulated tipster advice under French or foreign law.

BetHoop helps you analyze; it does not decide for you.No analysis tells you “wager X amount now”. The decision to bet or not, the choice of operator, the amount wagered, the bankroll strategy, and compliance with the regulation of your jurisdiction, are exclusively your responsibility.

Sports outcomes are inherently uncertain. Past performance does not predict future results. No model, even calibrated on five seasons of cross-referenced data, can predict the outcome of a single game with certainty. We cannot be held responsible for:

  • Financial losses linked to bets placed following our analyses.
  • “Missed” gains in the event of an inaccurate or unavailable analysis.
  • A betting decision made against, or contrary to, our analyses.
  • Disputes between you and a third-party betting operator.

8. Affiliate program and creator obligations

Influencers and creators may participate in our affiliate program. Affiliates may share promotional codes that grant their audience a one-time discount on the first billing period. Compensation is agreed individually (typically on a pay-per-view basis) and is governed by a separate written agreement that takes precedence over these Terms for the affiliate relationship.

Transparency obligation. Any creator promoting BetHoop in exchange for compensation undertakes to comply with:

  • French Act n° 2023-451 of June 9, 2023 regulating commercial influence, and the ARPP recommendation: clear and visible mention “Advertisement” or “Partnership” at the start of the content.
  • The FTC Endorsement Guides (16 CFR Part 255) for content visible from the United States: clear and unavoidable disclosure of the sponsored nature.
  • No promise of an individual gain, a specific return on investment, or any guaranteed outcome to the audience.
  • No promotion of BetHoop to a minor audience or to an audience whose majority is composed of minors.

Any breach triggers immediate termination of the affiliate agreement and forfeiture of any outstanding compensation.

9. Intellectual property

All content, software, models, prompts, designs and trademarks within BetHoop are owned by BetHoop or its licensors. NBA, WNBA, team names, logos and other third-party marks belong to their respective owners and are used for identification purposes only, under fair-use principles. No content of the service may be reused for commercial purposes without our prior written consent.

10. Personal data

Processing of personal data is described in our Privacy Policy, which forms an integral part of these Terms.

11. Limitation of liability

To the maximum extent permitted by applicable law, BetHoop and its operators are not liable for indirect, incidental, consequential, special or punitive damages — including loss of profits, loss of data, or any gambling losses — arising from or related to use of the service. Our aggregate liability shall not exceed the amount you paid us in the twelve months preceding the claim. Nothing in these Terms excludes liability that cannot lawfully be excluded (in particular liability for gross negligence, fraud, death or personal injury under French law).

12. Service availability

We aim for high availability but do not guarantee an uninterrupted, error-free service. Maintenance windows may temporarily reduce availability. We are not liable for outages caused by sub-processors, internet infrastructure, force majeure, or third-party action.

13. Termination

You may close your account at any time from the account menu. We may suspend or terminate accounts that violate these Terms, with notice where reasonable. On termination your access ends and your data is deleted subject to the legal retention obligations described in the Privacy Policy.

14. Changes to these Terms

We may update these Terms. Material changes will be notified by email or in-app at least 15 days before they take effect. After a material update you will be prompted to accept the new version at next login; refusing to accept ends your right to use the paid service (a prorated refund is then granted on request for the remaining period).

15. Consumer dispute resolution

EU consumers: in case of a dispute that we cannot resolve amicably, you may use the European Commission Online Dispute Resolution platform: ec.europa.eu/consumers/odr. Once BetHoop is incorporated as a French company, the contact details of our consumer mediator (médiateur de la consommation) will be listed here, as required by Articles L612-1 et seq. of the French Consumer Code.

US / Canada: please contact hello@bethoopai.com first; we engage in good-faith resolution within 30 days. Nothing in these Terms restricts statutory consumer rights applicable in your state or province.

16. Governing law & jurisdiction

These Terms are governed by French law.

Consumers residing in the European Union:in accordance with Article 17 of Regulation (EU) n° 1215/2012 (Brussels I bis), you may bring an action either before French courts or before the courts of your place of domicile. Conversely, any action brought by BetHoop against an EU-resident consumer will be filed before the courts of the consumer's domicile. No clause of these Terms can deprive you of the protection of mandatory provisions of the law applicable to your habitual residence.

Non-EU users: disputes fall under the jurisdiction of French courts, without prejudice to public-policy consumer protection rules applicable in your country of residence.
